HIGHLY STRUNG ENTERTAINMENT - TERMS AND CONDITIONS

A submitted booking confirmation form constitutes a contract between you ('the client') and Highly Strung Entertainment ('the artist') to deliver live music ('the performance') at an agreed location ('the venue'). By submitting a booking confirmation form, the client accepts and agrees to abide by the following Terms and Conditions:

1. Entertainment and equipment

1.1 The artist agrees to provide the client with a performance of three (3) or four (4) live sets as required by the client. The artist also agrees to provide, set up and operate PA, audio mixing, stage and dance floor lighting equipment and recorded music during breaks. Production will be overseen by the artist's audio/lighting technician.

1.2 The artist agrees to negotiate with the client when selecting the content, organisation and scheduling of the performance. However the artist retains the right to make final decisions with regard to performance content. The artist is under no obligation to grant the client oversight of the performance set list.

1.3 Where the size, acoustics or other attributes of the venue require the hire of additional equipment, such as a larger PA, the client shall be liable for these additional costs. In most cases these costs will be discussed beforehand and incorporated into the quoted booking fee. Where the client has not provided adequate information about the venue, or where the client changes the venue after the booking confirmation has been received, the artist reserves the right to revise the booking fee or cancel the booking.

1.4 The artist agrees to provide standard coloured LED lighting for the stage and dance floor areas. The artist can provide additional lighting and/or effects (e.g. smoke, mirror ball, lasers) at the client's request, however the client will be liable for the cost of this additional equipment.

1.5 The artist agrees to provide well maintained and functioning equipment, however the artist will not be liable for technical problems, power outages or other equipment that may affect the length, composition or acoustic quality of the performance.

2. The venue

2.1 The client will provide the artist with venue information, including the venue name, address and contact details. The venue should not be a private home, shed, barn, factory or outdoor location, without the prior approval of the artist.

2.2 The client and/or the venue will provide the artist with the following:

a. A performance space no smaller than 11 metres (length) 2.2 metres (height) and 4 metres (depth). This space must be clear of floor or overhead obstructions and have access to at least six (6) nearby power outlets.

b. Unobstructed access to the performance space, by foot and hand trolley, for bumping in and out. The client is to inform the artist if access is required by stairs or elevator.

c. Access to the venue at least three (3) hours prior to the venue opening and/or scheduled arrival of the first guests. (Note: the artist requires approximately ninety (90) minutes for bumping in and setting up, followed by a brief soundcheck. At the conclusion of the performance the venue should allow at least ninety (90) minutes for the artist to tear down and bump out all equipment.)

d. A space of approximately three (3) metres square for the artist's mixing desk and lighting controls. This space should, as much as practicable, be located in front of the performance space.

e. A storeroom or secure area for stowing of spare equipment, equipment cases and personal belongings during the performance.

f. Adequate supervision and/or security to ensure that the artist and/or the artist's equipment are not impeded, harassed or damaged by guests, patrons or other parties. Where the artist's equipment is marked, damaged or stolen by the client and/or the client's guests, the client shall be liable for the cost of equipment repair or replacement.

g. The artist shall be provided with free car parking at the venue for six (6) vehicles. Where free parking is unavailable, the client shall be liable for the cost of this parking.

3. Rider

3.1 The artist is to be provided with meals, non-alcoholic beverages, bottled or filtered water and tea/coffee for six (6) people. If the client and/or venue is unable to provide this then the client will be liable for a surcharge of $120, in addition to the agreed booking fee. Meals should be available to the artist at least one (1) hour prior to the scheduled start of the performance.

3.2 The artist is to be provided with either a green room, a reserved table and/or seating, for use when not performing.

4. Payment, cancellation and rescheduling

4.1 The client shall pay the artist a holding deposit of $100 or 10 per cent of the agreed booking fee, whichever is the greater amount. On receipt of this deposit the artist shall hold the client's preferred date.

4.2 The client shall pay the artist the full balance of the booking fee no later than seventy-two (72) hours prior to the scheduled start of the performance. Where payments are made by electronic funds transfer (EFT) the client should allow an additional forty-eight (48) hours for these funds to clear. Where full payment has not been received, the artist reserves the right to demand immediate payment or cancel the performance.

4.3 Where the client cancels the booking less than thirty (30) days prior to the performance date, the client shall forfeit the holding deposit. For cancellations more than thirty (30) days prior to the performance date, the holding deposit may be returned at the artist's discretion.

4.4 The client is permitted to reschedule the booking once, provided the artist is available to perform on the rescheduled date. Where the artist is not available, the holding deposit may be returned at the artist's discretion.
